1. Acceptance

By accessing or using simwide.com and any WIDE subdomains, you agree to these Terms of Service. If you do not agree, please do not use this site. These Terms are governed by Italian law and applicable European Union regulations.

2. About this site

lab.simwide.com ("Parta Lab") is operated by WIDE di D. Papa, Naples, Italy, as its AI LoRA training and fine-tuning service. The site presents information about the service, its pricing tiers and provides a contact and project brief form. Engagement in a paid project is subject to a separate written agreement or accepted quote in addition to these Terms.

3. Use of the site

You agree to use this site lawfully and only for its intended purpose. You may not:

• Attempt to gain unauthorised access to any part of the site or its infrastructure.
• Use automated tools to scrape, crawl or harvest data without prior written consent.
• Transmit harmful, unlawful or fraudulent content through the contact or project brief form.
• Use the site in a manner that could damage, disable, overburden or impair it.

4. Submission of reference material and third-party data

Where you submit reference material or source data for a training engagement, across Visual, Language or Edge categories (including but not limited to images, video, text, conversational data or target hardware specifications), you warrant that you hold all necessary rights, permissions and, where the material contains personal data of any third party, the necessary legal basis and consent for that material to be processed and used for the requested purpose.

You agree to indemnify and hold WIDE di D. Papa harmless from any claim, liability or cost arising from material you submit that infringes the rights of any third party or is submitted without the necessary consents.

Submitted material and any resulting training artefacts are retained for 30 days from the later of submission or project completion, after which they are permanently deleted, as further described in our Privacy Policy.

5. Use of trained models and outputs, AI Act compliance

You are solely responsible for your intended use of any model or adapter delivered under this service, whether Visual, Language or Edge, and for any content generated or inference performed using it, including compliance with Regulation (EU) 2024/1689 (the AI Act) and any other applicable law, such as obligations relating to transparency and labelling of AI-generated or AI-modified content, disclosure to end users that they are interacting with an AI system where required, intellectual property and the rights of individuals depicted in any output.

For Edge deliverables specifically, once a model is deployed on your own hardware or infrastructure, responsibility for its compliant operation, including any data processed by the deployed device or system, transfers to you. WIDE di D. Papa's responsibility as a processor or controller is limited to the scoping and training phase described in section 4.

WIDE di D. Papa does not knowingly provide services in support of prohibited AI practices under Article 5 of the AI Act, and reserves the right to decline or discontinue any engagement it reasonably believes would result in such use, without liability for doing so.

6. Intellectual property

All content on this site — including text, design, graphics, code, product names and the WIDE logo — is the property of WIDE di D. Papa or ae Aeonian Engineering Limited and is protected by applicable intellectual property law. No content may be reproduced, distributed or used without express prior written authorisation.

The WIDE wordmark, logo and product names (including Parta, AviMan, RENTRI, Simwide Heat, WizPixel Flow, Identity Standard and related names) are proprietary designations of their respective owners.

Unless otherwise agreed in writing, ownership and licensing of a delivered LoRA adapter is governed by the separate written agreement or accepted quote for that engagement.

7. Third-party links

This site links to external platforms including simwide.com, aeonianengineering.com and heat.simwide.com. WIDE is not responsible for the content, accuracy, availability or privacy practices of any linked third-party sites.

8. Disclaimer of warranties

This site and the services described on it are provided on an "as is" basis without warranties of any kind, express or implied. WIDE does not warrant that the site will be uninterrupted, error-free or free of harmful components, nor that a trained adapter will achieve any particular result beyond what is agreed in the specific project scope. Information on this site may be updated without notice.

9. Limitation of liability

To the extent permitted by applicable law, WIDE di D. Papa shall not be liable for any indirect, incidental, special or consequential damages arising from use of or inability to use this site or the services described on it, including loss of data or business interruption, except as otherwise agreed in a specific project's written agreement.

10. Contact form and communications

Use of the contact or project brief form constitutes an enquiry, not a binding contract. Submission of a message does not create any contractual relationship between you and WIDE. Any contractual engagement is subject to a separate written agreement or accepted quote.

11. Modifications

WIDE reserves the right to modify these Terms at any time. Updates are effective upon publication. Continued use of the site constitutes acceptance of revised terms. The date shown at the top of this page reflects the most recent revision.

12. Governing law and jurisdiction

These Terms are governed by the laws of Italy. Disputes arising from or related to use of this site or the services described on it shall be subject to the exclusive jurisdiction of the courts of Naples, Italy, except where mandatory consumer protection rules in your country of residence apply.
